New Sharjah rental law: Authorities clarify fees and fines

Tenant’s fines not landlord’s responsibility, Sharjah legal expert confirms

Dr. Mansour bin Nassar, Legal Advisor and Head of the Legal Department in the Government of Sharjah, clarified that Article 10 of the Sharjah Rental Law clearly states that landlords (property owners) cannot be held responsible for any fees, fines, or expenses that are the tenant’s responsibility—unless both the landlord and tenant agreed to it in their rental contract.

Dr. bin Nassar explained that the Sharjah legislator made sure the law protects the rights of both landlords and tenants fairly and equally. The law is based on general legal principles and Islamic teachings, including the idea that “no one bears the burden of another’s mistake.”

He also called on all related authorities—whether it’s the municipality, Sharjah Electricity, Water and Gas Authority, or any other relevant body—to follow the new law carefully. If any issues or uncertainties come up, they can always contact the Sharjah Government’s Legal Department for clarification.

Dr. bin Nassar made these comments during phone call on the live radio programm (The Direct Line). His explanation came in response to a caller who had rented out a salon and later faced several problems. The caller was surprised to find that he was being asked to pay fines that were actually the responsibility of his tenant.
